What really happened at Kampung Baru Plentong Tengah

Yesterday, I posted HERE about the arresting of 25 villagers and activists trying to protect the housing rights of the people of Kampung Baru Plentong Tengah, Johor. Apparently, 300 police officers were there to aid the developers in evicting the villagers, who have yet to receive their end of the bargain.

This morning, I received another email from SUARAM JB reading like this:

The arrested villagers and activists were all released with bail at around 7.36pm after taking 112 statements. We thank everyone who were concerned and gave support to the people struggle for basic rights.

Kampung Baru Plentong Tengah villagers had submitted an injunction application and the case is scheduled for 29 October 2008, about 2 weeks from now. The villagers are expected to face another round of forced eviction soon. We will continue update you on the latest development of the case.

Again, many thanks for your support. The struggle will go on.

Along with the email, came the chronology of the events that led up to yesterday’s forced eviction and arrests:

1985 – Penduduk meneroka tanah. Pejabat Tanah memaklumkan bahawa tanah tersebut tiada pemilik. (Villagers open land. Land Office (Department?) told them that the land has no owner.)

1986 – KBPT terbentuk. Penduduk memohon hak milik tanah. Pejabat Tanah kata tanah dimiliki Syarikat Mosbert. (KBPT is formed. The villagers apply for ownership of the land. Land Office inform them that the land is owned by Syarikat Mosbert.)

1987 – Tanah ditukar tangan kepada Jet Ace Co. dan seterusnya kepada Oakfield. (Land ownership changes hands to Jet Ace Co. and later to Oakfield.)

1989 – Penduduk kalah kepada Oakfield di Mahkamah Tinggi JB dengan perintah milikan kosong. (Villagers lose to Oakfield in JB High Court with order of empty ownership.)

1990 – Dalam usaha mendapatkan ehsan DYMM Sultan Johor, penduduk ditipu sebanyak RM 18,000.00 oleh ‘orang tengah’.  (In attempts to get blessing from DYMM Sultan Johor, villagers were cheated of RM18K by ‘middleman’.)

1991 – Atas cadangan wakil rakyat, penduduk membentuk tabung bertujuan membeli tanah daripada Oakfield. (Advice from representative – not sure if wakil rakyat here means MP – villagers start a fund for purposes of buying the land from Oakfield.)

1993 – Pembayaran pendahuluan penduduk dari wang tabung sebanyak RM 417,307.93 digelapkan oleh peguam. (FIrst payment by the villagers from the fund of RM417,307.93 was ‘eaten’ by lawter[s].)

1993 – Oakfield melakukan perobohan rumah. Atas suruhan wakil rakyat, penduduk melarikan diri ke dalam hutan. Selepas itu, penduduk membelanjakan RM 22,000.00 untuk membebaskan seorang penduduk yang tidak sempat lari dan ditahan oleh polis. (Oakfield went on to demolish houses. Under directions from representative, villagers flee into the forests. After that, villagers spend RM22K to release one villager who didn’t make it in time and was arrested by police.)

1993 – Atas cadangan peguam, penduduk menanggung kos menghantar wakil untuk memohon wang kebajikan atarabangsa di Filipina. (Advice from lawyer, villagers bear the cost of sending a representative to appeal for money from international funding in Philippines.)

1993 – Penduduk menang kepada Oakfield di Mahkamah Rayuan KL dengan ketepikan perintah kommintal Mahkamah Tinggi JB. (Villagers win Oakfield in KL Appeal Court, JB High Court order sidestepped.)

1994 – Oakfield setuju menjual tanah kepada penduduk. Perundingan pembelian tanah dimula. (Oakfield agrees to sell land to villagers. Discussions on buying of land start.)

1994 – Penduduk ‘menghilangkan’ RM 820,000.00 kepada Oakfield melalui peguam J. Sing & Co. (Villagers ‘lose’ RM820K to Oakfield through lawyers J.Sing & Co.)

1995 – TNB membekalkan elektrik ke KBPT. (TNB provides electricity to KPBT)

1996 – Bukit Lenang Development Sdn. Bhd. ambil milik tanah KBPT. Pemaju menawarkan pampasan kepada penduduk yang berpindah. Penduduk tidak setuju kerana rasa nilai pampasan tidak setimpal. (Bkt Lenang Development Sdn. Bhd take over land of KPBT. Developer offer compensation to villagers to move. Villagers did not agree because they felt the compensation value was not fair.)

1997 – Penduduk buat aduan polis terhadap Oakfield yang jualkan tanah sedangkan proses jual-beli dengan penduduk tengah diproses. (Villagers file police report against Oakfield because they sold the land although their buy-sell process with the villagers was still on-going.)

1997 – Bukit Lenang saman penduduk. Bukit Lenang menolak cadangan tuntutan ganti rugi penduduk. (Bkt Lenang fine the villagers. Bkt Lenang turn down suggestion of compensation to villagers.)

1997 – Penduduk membuat kempen tandatangan dan hantar surat kepada MB Johor atas sokongan Jawatankuasa Sokongan Peneroka Bandar (JSPB). (Villagers start petition and sent letter to MB of Johor with support from JSPB.)

1998 – Penduduk kalah di Mahkamah Tinggi JB dengan perintah milikan kosong tetapi terus merayu. (Villagers lost in JB High Court with order of empty ownership but continued to appeal.)

1999 – Kerajaan Johor mengurniakan tanah Kg. Bukit Dagang kepada penduduk. (Johor State Govt award Kg Bkt Dagang land to villagers.)

2000 – Bukit Lenang menjalankan operasi pengusiran secara paksa. Penduduk turun sama-sama dan berjaya mempertahankan rumah. (Bkt Lenang carry out forced eviction. Villagers stood together and managed to protect their houses.)

2000 – Penduduk menang kes di Mahkamah Rayuan KL. (Villagers won in KL Appeal Court.)

2002 – Penduduk kalah di Mahkamah Tinggi JB. (Villagers lost in JB High Court.)

2007 – Penduduk kalah di Mahkamah Rayuan Putrajaya. (Villagers lost in Putrajaya Appeal Court.)

2008 – Bukit Lenang mendapat notis perintah mahkamah. (Bkt Lenang get court order.)

16 Okt 2008 – Polis menyalahgunakan kuasa dan menggunakan keganasan untuk menahan penduduk yang mempertahankan rumah halaman. (Police abuse their powers and use force to arrest villagers who defended their homes.)

I really don’t know if one should be surprised at the amount of money that was involved in all this, and yet till this day, the villagers have nothing.

    wakil pihak pemaju (bukit lenang) ada menyatakan seramai tidak lebih 15 orang penduduk kg baru plentong tengah telah menerima bayaran pampasan tetapi tidak diketahui siapakah yang menerimanya, adakah benar seramai itu atau ada yang cuba memanipulasikannya….kami di bukit dagang tidak disediakan sebarang infrastuktur atau kemudahan awam, adakah kami bukan rakyat malaysia????adakah kami bukan bangsa manusia yang sedang memerintah??? — 1 from 25 —-
